The Federation
Om Nagar Cooperative Housing Society Federation was formed in 2001 and got it registered in 2003. Sole object was to co-ordinate the welfare activities for all member societies. Now the perspective of the Federation has broadened. The Redevelopment of Om Nagar Layout as one unit through a developer is a dream aim of Federation. The short background of this entire modified vision can be traced back to 2010.
In 2010, the redevelopment process was in everybody’s mind and the things started moving swiftly. However, everything was getting obstructed just because of lacking the possession of much needed ownership of Om Nagar Layout land.
In the meantime, Federation filed an RTI application for getting all documents/plans of its area with the help of an Architect and was successful in getting the same.
At this point, the Federation got a clue in the form of an advertisement published in a newspaper for the re-sale of plot No.167/3 which belongs to the parent societies. As per advice offered by consultants, the objection was taken to the said resale of plot 167/3 in the form of Legal Notice through an Advocate. After going through the available documents and advice offered by the consultant, the Federation decided to go for the deemed conveyance since the case was complicated one and entrusted the task to him.
Then, Federation swung into action and decided to entrust him with the responsibility to get viability and positive/negative status for obtaining conveyance. His firm sent two legal notices to Wadia Trust and Indico Construction Co. A reply received from M/s Consult Legal, a firm representing Wadia Trust and from the Adv. of the contractor/builder. From these replies the correct information was elicited and there was a realization that the conveyance would be obtained only from Wadia Trust. The contractor/builder has no role to play other than to create hurdles.
Sensing the huge workload and seriousness of the task, the Federation decided to restructure itself, to become more comprehensive and inclusive in nature. The AGM decided to have more representation form among the member societies which would subsequently form the general body of the Federation. Managing Committee members of all member-societies would therefore become the members of General Body of the Federation. The President, the Secretary and any one elected Committee Member of all member-societies would form the Managing Committee of the Federation. This underlines all societies’ involvement in every decision-making process of the Federation and evolves transparency.
Structure of The Federation Managing Committee
Each member society nominates one elected member from their managing committee as its representative to become the member of the managing committee of the Federation.
At present Federation is having 9 member-societies and there are 9 members nominated to the Federation Managing Committee.
3 Office-bearers of the Federation are selected from among 9 members nominated from elected managing committee members from member-societies.
The Federation later decided to call for more nominations from the member-societies to have a wide representation and transparency. Therefore, all 9 member societies send 2 more nominations to the Federation Managing Committee. Now, the Federation is having 27-member committee which consists of the President, the Secretary and any one from elected managing committee member from all the member-societies.

The election of the Om Nagar CHS Federation Ltd. was held on 2nd July 2023.
An election officer appointed by State Co-operative Election Commission, Pune chaired the meeting. All Committee members were elected unopposed. Thereafter the election for the office bearers was also held in which all office bearers were elected unopposed. The election was for the period of 5 years from 2023-2024. The Election report was acknowledged by the Dy. Registrar, K East on 8th August 2023.

Conveyance
The conveyance struggle was stretched from 2011 to 2016. In 2016, as per High Court directive A H Wadia Trust and the Federation agreed upon a consent terms formula and in October the said Consent Terms Document was presented before the High Court, which was agreed upon by all the concerned parties and A H Wadia Trust withdrew all writ petitions and suit against the Federation and the land was formally handed over to the Federation for mutually agreed monetary consideration to the Trust. Adjudication and Registration took 5 more years and in September 2021 the Federation became proud owner of the Om Nagar Layout.
Though the Federation became owner, there remain some illegal possessions of a Garden Plot (167/12) and a Greenbelt Area (167/20). These are encroached unauthorizedly by the contractor, who constructed rest of the buildings in Layout Area. A legal solution for the re-possession of these plots is being considered by the Federation.
Plot No. 167/3 (Sai kinara / Planet Health) plot is in Om Nagar Layout and the Federation has in its possession a Deemed Conveyance Order, which remains to be unregistered so far. Though had original reservation as of Maternity Home, the contractor reportedly sold the development right to a builder. This builder constructed a structure (2/3 story building) for residential and commercial purpose and reportedly sold it. Some took possession, some did not. Some years back BMC demolished some portion of the structure as unauthorised. But presently there seems to be a change in holding the development rights and a new construction activity is being seen.
Plot No.167/13 which was originally marked as Garden Plot for entire Om Nagar Layout mysteriously got development rights, changed hands in property card name and now a 6/7 story structure stands there fully occupied. The Federation has obtained a Deemed Conveyance order for this Garden Plot too. It is considering a suitable legal solution in due course.
Redevelopment
Right from the moment the Federation decided to go for Deemed Conveyance and ownership of land, there was a clear-cut vision about at what end the whole process should lead to - the redevelopment of entire Om Nagar Layout area as one single unit. The Federation started discussions and deliberations on the various ways to go for redevelopment right after the registration of the Deemed Conveyance Deed on 3rd September 2021. The Government Circular of 4th July 2019 was base to all these discussions.
It was observed that the division of the previous different Survey Numbers which were superseded by newly formulated 20 plots numbering from 1 to 20, on Om Nagar Layout while construction took place in 80s and 90s. This position was twisted by Devadig B1, a member-society and decided to file a writ petition in high-court against deemed conveyance order obtained by federation in 2013. Vidyadani CHS - A1 followed B1. Later they had to withdraw the petition. When the registration of the conveyance of Federation took place on 3rd September 2021, they approached the Federation and wished to join it for redevelopment. The Federation consented on various terms and conditions (of clearing entire outstanding, starting conveyance procedure immediately, collection for stamp duty payments, payments of legal expenses etc.) agreed upon by SGMs of both member-societies. And Federation finally decided to include the areas of both the societies for the purpose of redevelopment of Om Nagar Layout as one single unit through a developer.
